Introduction
Welcome to Yamue Stores ("Yamue," "we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of our website, mobile application, tools, features, and services (collectively, the "Yamue Services"). By accessing or using Yamue Stores, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you may not use Yamue Services.
1. Your Agreement With Yamue Stores
By using Yamue Stores, you enter into a legally binding agreement with Yamue, Manitoba, Canada, the owner and operator of the platform. This agreement includes our Terms of Use, Privacy Policy, and any additional guidelines posted within the platform.
By continuing to use the platform, creating an account, or conducting transactions, you confirm that you accept all policies and agree to abide by them.
Yamue Stores may update or revise these Terms from time to time. When changes are made, we will notify users through email, app notifications, or by updating the "Last Updated" date. Continued use of Yamue Services after changes constitutes acceptance of the updated Terms.
2. Eligibility and Account Requirements
To use Yamue Stores, you must be at least 16 years old or the age of digital consent in your country.
When you create an account—whether as a customer, seller, or service provider—you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Yamue Stores is not responsible for any loss arising from unauthorized use of your account. If you suspect unauthorized activity, you must notify us immediately.
3. Use of Yamue Services
You may use Yamue Stores only for lawful purposes and in accordance with these Terms.
You agree not to:
- Engage in fraudulent, abusive, or malicious behavior.
- Upload harmful software, including viruses or malicious code.
- Attempt unauthorized access to the platform, other user accounts, or restricted systems.
- Misrepresent your identity or impersonate another person or business.
- Use the platform to sell illegal, counterfeit, or restricted goods.
- Interfere with the performance, integrity, or security of Yamue Services.
Violations may result in account suspension or termination, and where applicable, legal action.
4. Business & Seller Accounts
Businesses using Yamue Stores—including merchants, vendors, restaurants, freelancers, and service providers—must comply with all applicable local, provincial, national, and international laws.
By registering a business account, you agree to:
- Provide truthful business details, documents, and ownership information.
- Maintain valid licenses, permits, and certifications required for your services.
- Accurately list, describe, and price your products or services.
- Fulfill orders, bookings, and commitments made through the platform.
- Provide customer support within reasonable response times.
- Adhere to Yamue Stores' return, refund, and cancellation policies.
- Accept that customer reviews and ratings will be publicly displayed.
Businesses also agree that Yamue Stores may verify business information and suspend marketplace access if compliance issues arise.
5. Transactions and Payments
All payments on Yamue Stores are processed securely through Stripe, our authorized payment partner. By making purchases or accepting payments through Yamue Stores, you agree to Stripe's terms of service and conditions.
For each transaction, Yamue Stores may charge:
- Marketplace commissions
- Service fees
- Delivery or logistics fees
- Booking or convenience fees
These fees are clearly communicated during checkout or account setup. Yamue Stores reserves the right to adjust fees, and any changes will be communicated in advance.
Yamue Stores does not control and is not responsible for:
- The quality or performance of products sold by third-party sellers
- The accuracy of listings or descriptions
- Delivery timelines for sellers who handle their own logistics
- Delays caused by payment processors or bank institutions
6. Transactions With Third-Party Sellers and Service Providers
Yamue Stores provides a marketplace that includes goods and services sold by independent third-party sellers and providers. When you purchase from these parties, you enter a direct commercial relationship with them.
For clarity:
- Yamue Stores hosts listings, processes payments, and facilitates delivery or booking when applicable.
- Third parties are solely responsible for product quality, authenticity, service delivery, warranties, and customer obligations.
- Yamue Stores may share relevant customer information with third-party sellers or service providers strictly to fulfill orders or bookings, in accordance with our Privacy Policy.
You can always identify when a transaction involves a third-party merchant through the product or seller detail pages.
7. Intellectual Property
Unless otherwise stated, all content on Yamue Stores—including text, graphics, icons, logos, designs, user interface, and software—is the exclusive property of Yamue Technologies Inc. and is protected under copyright and trademark laws.
You may not:
- Copy, reproduce, or distribute Yamue content
- Reverse-engineer or modify software components
- Use trademarks without written permission
Sellers retain ownership of their content but grant Yamue Stores a license to display, promote, and use their listings within the platform.
8. Reviews, Ratings, and User Content
Users may post reviews, comments, photos, or feedback on products or services. By doing so, you grant Yamue Stores a global, royalty-free license to use, reproduce, and display this content.
Content must not be:
- defamatory
- misleading
- offensive
- infringing on intellectual property
- promotional spam
- false or fraudulent
Yamue Stores reserves the right to remove inappropriate or harmful content at its discretion.
9. Returns, Refunds, and Cancellations
Return and refund policies vary depending on:
- the category of product
- the type of seller
- local consumer protection laws
Yamue Stores publishes clear guidelines for eligible returns, refund processing timelines, and seller obligations. Sellers must comply with Yamue Stores' return and dispute policies.
Service bookings (e.g., salons, freelancers, restaurants) may follow different cancellation rules, which will be stated on the service page.
10. Platform Availability & Service Interruptions
While we aim to provide uninterrupted access to all Yamue Services, we do not guarantee that the platform will always be available.
Occasional interruptions may occur due to:
- system maintenance
- security updates
- network failures
- external service disruptions (e.g., Stripe, hosting providers)
Yamue Stores is not liable for losses resulting from such interruptions.
11. Limitation of Liability
To the fullest extent permitted by law:
- Yamue Stores is not liable for indirect, incidental, special, punitive, or consequential damages
- We are not responsible for losses caused by third-party sellers, service providers, or logistics partners
- Our total liability for any claim shall not exceed the amount paid for the specific transaction giving rise to the complaint
You agree to use Yamue Stores at your own risk.
12. Termination of Use
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or harmful behavior
- Abuse the platform or other users
- Fail to comply with business or seller standards
You may also close your account at any time through your account settings.
Termination does not prevent Yamue Stores from pursuing legal remedies if necessary.
13. Governing Law
These Terms are governed by the laws of Manitoba, Canada, without regard to conflict of law principles. Any disputes shall be resolved exclusively through courts located in Manitoba.
